TERMS AND CONDITIONS Last updated: October 22, 2026 These Terms and Conditions (these “Terms”) govern your access to and use of the website, mobile application, booking platform, payment and communication features, and related marketplace services provided by Ringeaux Enterprises, LLC d/b/a Stay (“Stay,” “we,” “us,” or “our”) (collectively, the “Services”). These Terms form a binding agreement between Stay and each pet owner or other customer who accesses or uses the Services, creates an account, makes a reservation, submits information through the Services, or otherwise interacts with Stay through the Services (“you” or “your”). Participating boarding, daycare, and other third-party pet-care facilities and service providers are referred to in these Terms as, individually, a “Facility or, collectively, “Facilities.” Each Facility participates
in the Stay marketplace under a separate agreement with Stay and is not a party to these Terms. Please read these Terms carefully. By accessing or using the Services, creating an account, making a reservation, or submitting information through the Services, you agree to be bound by these Terms and any additional policies, waivers, consent forms, Facility rules, or written instructions presented to you in connection with a reservation or your use of the Services.
1. Marketplace Services and Role of Stay. Stay operates a technology marketplace that enables users to search for, compare,
request or book, pay for, and communicate regarding boarding, daycare, and other pet-care services offered and performed by independent Facilities (collectively, “Pet Care Services”). Stay provides the marketplace, booking, payment, account, communication, and related technology features that comprise the Services. Stay does not own, operate, manage, possess, staff, or control the Facilities and does not itself provide boarding, daycare, veterinary care, transportation, or other hands-on Pet Care Services. Each Facility is an independent third-party business and is solely responsible for its premises, personnel, licenses, permits, insurance, policies, listings, availability, pricing, Pet Care Services, and compliance with applicable law. A reservation made through the Services is for Pet Care Services to be performed by the applicable Facility,
not by Stay. Stay may modify, suspend, discontinue, or limit any portion of the Services or a Facility’s access to the marketplace at any time, subject to applicable law and any separate written agreement between Stay and the Facility.
2. Eligibility and Authority. You must be at least eighteen (18) years old to create an account, make a reservation,
submit payment, or otherwise enter into a binding transaction through the Services. By doing so, you represent that you are at least eighteen (18) years old and have the legal authority to agree to these Terms. If you use the Services on behalf of another person or entity, you represent that you are authorized to do so. If you make a reservation or provide instructions for a pet, you represent that you are the owner of the pet or are otherwise authorized by the owner to make decisions, provide instructions, authorize care, and agree to these Terms on behalf of the owner.
3. Accounts and Information Provided by You. A. Account Information . Certain Services may require you to create an account or provide information through
the website, app, or other booking process. You agree to provide accurate, current, and complete information and to promptly update information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account.
B. Pet Information . You agree to provide accurate, current, and complete information regarding each pet,
including, as applicable, the pet’s name, age, breed, weight, medical history, vaccination status, medications, behavioral history, allergies, dietary needs, special-care instructions, veterinarian information, emergency contacts, and any conditions that could affect the safety, health, or comfort of the pet, other animals, Facility personnel, or third parties. You agree to promptly update information provided through the Services and to notify the applicable Facility of any material change to a pet’s health, vaccination status, behavior, medication, diet, or care requirements before or during a reservation, as appropriate. You may not submit falsified, altered, fabricated, manipulated, or misleading vaccination records, health records, or other documentation. Stay and the applicable Facility may rely on the information you provide, and you
are responsible for consequences arising from inaccurate, incomplete, outdated, or falsified information.
4. Reservations, Check-In, and Check-Out. A. Reservations . Reservations are subject to the availability, eligibility requirements, policies, and
acceptance criteria established by the applicable Facility and reflected through the Services. A reservation confirmation issued through the Services confirms the booking transaction but does not constitute a guarantee by Stay of the Facility’s performance of Pet Care Services. Stay may decline, suspend, modify, or cancel a reservation for payment, fraud-prevention, platform, administrative, legal, or compliance reasons, and a Facility may accept, decline, or cancel a reservation as permitted by its policies and its agreement with Stay.
B. Check-In Requirements .
You agree to comply with the applicable Facility’s check-in procedures and to provide all required information, forms, consents, payment details, vaccination records, medications, food, supplies, and instructions before or at check-in. The Facility, not Stay, determines whether check-in requirements have been satisfied and whether a pet may be admitted to the Facility. C. Check-Out and Late Pick-Up . You agree to pick up your pet from the applicable Facility at the scheduled check-out or pick-up time. Late pick-up may result in additional fees, extended-care charges, or other charges disclosed through the Services or by the Facility. If a pet is not picked up as scheduled, the Facility may continue care, attempt to contact you or your authorized contacts, and impose charges or take other action as permitted by its policies and applicable law.
Stay does not take custody of pets or provide extended care.
5. Pet Health, Vaccinations, and Safety. A. Vaccination and Health Requirements . Stay or an applicable Facility may require proof of vaccinations, health records, parasite
prevention, negative test results, or other documentation as a condition of booking or receiving Pet Care Services. Requirements may vary by Facility, service type, pet type, local law, veterinarian guidance, or Facility policy. You are responsible for ensuring that all required vaccinations, medications, and preventive care are current before your pet receives Pet Care Services. Vaccination and other required health documentation submitted through the Services generally requires up to forty-eight (48) hours for verification. You should submit all required documentation sufficiently in advance of your reservation. Verification is subject to receipt of complete, accurate, and legible documentation, and submission does not guarantee verification or admission within that period. The applicable Facility retains authority to determine whether its
health and admission requirements have been satisfied. B. Illness and Communicable Conditions . You agree not to bring a pet to a Facility for a reservation if the pet has, or may have been exposed to, a contagious illness, parasite, unexplained symptom, or other condition that may create a health or safety risk or violate the Facility’s policies. You agree to promptly notify Stay through the Services and the applicable Facility if your pet develops symptoms of illness or a known communicable condition before, during, or shortly after a reservation. Such conditions may affect your pet’s eligibility for a reservation and any applicable cancellation or refund rights.
C. Behavior and Safety .
You agree to disclose any history of aggression, biting, resource guarding, anxiety, escape behavior, reactivity, destructive behavior, or other behavioral issues. The applicable Facility may separate, restrict, remove from group play, decline, or discontinue Pet Care Services for any pet if the Facility determines that doing so is appropriate for safety, operational, health, or welfare reasons. Stay may restrict or suspend access to the Services if a Facility reports conduct or circumstances that reasonably raise safety, fraud, or compliance concerns.
D. Inherent Risks . You acknowledge that boarding, daycare, group play, transportation arranged or
provided by a Facility, and other Pet Care Services involve inherent risks, including illness, injury, death, stress, scratches, bites, escape, loss, allergic reactions, behavioral incidents, aggravation of pre-existing conditions, and interactions with other animals. You acknowledge that these risks cannot be eliminated even when reasonable care is used. Stay does not supervise or control Pet Care Services or conditions at a Facility and, to the fullest extent permitted by law, is not responsible for injury, illness, death, loss, escape, or other harm arising from a Facility’s acts or omissions or from conditions at a Facility.
6. Emergency Care and Facility Responsibility. Emergency monitoring, medical determinations, owner contact, transportation,
veterinary referral, and other emergency-response decisions concerning a pet while at a Facility are the responsibility of the applicable Facility under its policies, procedures, and any separate consents or agreements between you and the Facility. Stay does not monitor pets at Facilities, diagnose medical conditions, determine whether emergency care is required, provide transportation, arrange veterinary treatment, or assume any duty to take such actions. You are responsible for all veterinary, emergency, transportation, medication, treatment, supply, and related costs incurred for your pet in connection with Pet Care Services. If Stay receives information from a Facility concerning an emergency, Stay may, as a convenience, attempt to relay that information through the Services or available contact information, but Stay does not assume responsibility
for the Facility’s emergency response or for any delay, failure, or error in communications. Stay is not a veterinary provider and does not guarantee the availability, timing, outcome, or cost of any veterinary or emergency care.
7. Fees, Payment, Cancellations, and Refunds. A. Fees and Charges . You agree to pay all amounts due in connection with reservations and your use of the
Services, including Facility charges for Pet Care Services, reservation or service fees, deposits, late fees, extended-care charges, cancellation fees, no-show fees, medication-administration fees, supply charges, cleaning fees, damage charges, veterinary or emergency-care costs, taxes, payment-processing fees, and other charges disclosed through the Services or by the applicable Facility before or in connection with the reservation. Prices, fees, availability, minimum-stay requirements, holiday pricing, and other booking rules may vary by Facility, location, date, service, and pet eligibility and may be established in whole or in part by the applicable Facility. Stay may correct platform or pricing-display errors and may decline, suspend, cancel, or modify a reservation if a payment, fraud-prevention, platform, legal, or compliance issue exists.
Facility-specific rules and charges disclosed before booking may also apply to the Pet Care Services. B. Payment Authorization and Processing . You authorize Stay and its third-party payment processors, including Stripe or any replacement processor used by Stay, to charge your payment method for amounts due through the Services in connection with a reservation. You represent that you are authorized to use any payment method you provide. If payment cannot be processed, Stay may suspend or cancel a reservation, restrict access to the Services, require another payment method, or pursue collection of amounts owed to Stay or, where authorized, amounts processed on behalf of a Facility. Payment processing fees charged by third-party payment processors are non-refundable to Stay. Unless otherwise required by law or expressly stated in writing by Stay,
responsibility for payment processing fees will be allocated based on the party initiating the cancellation. C. Pet Owner-Initiated Cancellations . Refund eligibility for pet owner cancellations is based on how far in advance the booking is canceled relative to the scheduled booking start time:
- More than forty-eight (48) hours before the booking start time: One hundred
percent (100%) refund, less applicable non-refundable payment processing fees, including, but not limited to, the 3.5% payment processing fee or any other processing fee disclosed by Stay.
- Within forty-eight (48) hours before the booking start time: No standard refund,
subject to Stay’s review of any extenuating circumstances described below. When a pet owner initiates a cancellation, any approved refund will be issued to the original payment method and reduced by all applicable, non-refundable payment processing fees, including fees incurred at the time of the original transaction and fees incurred to process the refund. Refund amounts may therefore be less than the original payment amount.
D. Facility-Initiated Cancellations .
If a Facility participating in the Stay marketplace cancels a confirmed booking, the pet owner will receive a full refund to the original payment method without deduction, unless otherwise required by law or expressly agreed in writing by the pet owner. Stay will administer any refund associated with a Facility-initiated cancellation in accordance with this Section. Any allocation or recovery of payment-processing fees, refund amounts, or other costs between Stay and the Facility is governed by the separate agreement between Stay and that Facility and does not reduce a pet owner’s refund where this Section provides for a full refund. Repeated, inaccurate, or last-minute Facility cancellations may result in marketplace or account action by Stay under the applicable Facility agreement because such cancellations may affect customer trust and marketplace
reliability. This provision describes Stay’s administration of the marketplace and does not make a Facility a party to these Terms. E. Stay-Initiated Cancellations . Stay may cancel or reverse a booking for payment, fraud-prevention, platform, legal, compliance, administrative, or similar reasons, or when a Facility notifies Stay that it cannot or will not honor the booking. If Stay cancels a booking for a reason not caused by the pet owner and not attributable to a Facility-initiated cancellation addressed above, the pet owner will receive a full refund to the original payment method without deduction, and Stay will bear the associated payment-processing fees, except where otherwise required by law or expressly stated in writing by Stay. Stay’s ability to cancel or reverse a booking does not mean that Stay supervises or controls a Facility’s
premises or Pet Care Services.
F. Extenuating Circumstances . Stay may consider refund exceptions on a case-by-case basis for extenuating
circumstances, including medical emergencies involving the pet or pet owner, natural disasters or severe weather events, documented safety concerns, or a Facility being materially different from its listing description. Requests for exceptions must be submitted to the Stay Support Team at support@staysitplay.com and are subject to review and approval in Stay’s sole discretion, subject to applicable law. Stay may request supporting documentation when reviewing exception requests. Approved refunds under extenuating circumstances will follow the fee-allocation rules above based on which party initiated or caused the cancellation, unless Stay determines otherwise in writing or applicable law requires otherwise. G. Refund Timing and Method . Approved refunds will be issued to the original payment method. Refunds are processed promptly following
approval, but they may take between five (5) and ten (10) business days (or longer) to appear, depending on the user’s financial institution, payment network, and payment processor. H. Separate Facility Agreements. These Terms govern the relationship between Stay and pet owners or other customer users of the Services. They do not create or alter contractual obligations owed by a Facility to Stay. If these Terms conflict with a separate agreement between Stay and a Facility, the Facility agreement controls as between Stay and that Facility. I. Final Authority and Policy Administration . Unless otherwise required by applicable law or expressly provided in these Terms, determinations concerning Facility-specific refund eligibility, cancellation exceptions, and related Pet Care Services policies will default to the discretion of the applicable
Facility, subject to the Facility’s disclosed policies and its separate agreement with Stay. Stay will administer refunds and payment processing through the Services in accordance with these Terms and retains authority over platform-related fees, fraud prevention, documentation requirements, and user-account action. Stay may update its marketplace refund and cancellation policies as needed to reflect operational, financial, legal, or marketplace changes, subject to applicable law and applicable written agreements. Nothing in this Section makes Stay the provider of Pet Care Services or responsible for a Facility’s performance of those services. Any rights or obligations between you and a Facility may also be governed by Facility-specific rules, consents, or agreements presented in connection with the reservation, subject to applicable law.
8. Customer Responsibilities. You agree to: ● Provide accurate and complete information about yourself, your pet, your
veterinarian, and your emergency contacts;
- Comply with all Stay policies, applicable Facility rules, app instructions, and
written directions provided in connection with a reservation;
- Provide the applicable Facility with required food, medications, equipment,
records, and supplies in properly labeled containers;
- Ensure your pet is healthy, appropriately vaccinated, and suitable for the
requested Pet Care Services;
- Disclose any medical, behavioral, dietary, or safety issues; ● Pick up your pet from the applicable Facility on time and remain reasonably
reachable by Stay and the Facility during the reservation period;
- Pay all amounts due when due; and
- Treat Stay personnel, Facility personnel, other customers, vendors, and third
parties respectfully and lawfully.
9. Personal Property and Pet Items. You may provide food, medication, bedding, toys, collars, leashes, harnesses, carriers,
or other items to the applicable Facility for your pet. You are responsible for labeling those items and complying with the Facility’s policies concerning personal property. Stay does not receive, store, maintain, or take custody of those items and is not responsible for any item that is lost, damaged, soiled, destroyed, discarded, or otherwise affected while in a Facility’s possession or control, except to the extent liability cannot be excluded by applicable law.
10. Mobile Application, Notifications, and Communications. The Services may include a mobile application, text messages, emails, push
notifications, phone calls, in-app messages, or other communications. By providing contact information or enabling notifications, you authorize Stay to contact you regarding your account, reservations, payments, policy updates, marketing, and other matters related to the Services. Stay may also facilitate communications between you and a Facility, including communications concerning pet care or emergencies, but does not guarantee that any communication will be delivered, received, or acted upon within a particular time. You may opt out of marketing communications where required or permitted by law, but Stay may still send non-marketing communications, including reservation confirmations, account notices, service updates, safety alerts, payment notices, and emergency communications. Standard message, data, and carrier charges may apply.
11. User Content, Photos, and Feedback. A. User Content . You may be able to submit, upload, transmit, or otherwise provide information,
messages, reviews, photos, videos, pet records, instructions, feedback, or other content through the Services (“User Content”). You represent that you have all rights necessary to provide User Content and that your User Content is accurate, lawful, and does not violate the rights of any person or entity. B. License to User Content . You grant Stay a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, transmit, and process User Content as reasonably necessary to provide, operate, improve, document, protect, and administer the Services. This license includes the right to share User Content with the applicable Facility, payment processors, service providers, veterinarians, emergency contacts, and other third parties as reasonably necessary to facilitate a reservation, operate the marketplace, process payments, or
transmit information relating to a pet or an emergency. C. Marketing Use of Photos and Videos . Stay may request or obtain separate permission to use photos, videos, testimonials, reviews, or other content for marketing or promotional purposes. Unless otherwise stated in a separate written consent, Stay will not use identifiable customer-submitted photos or videos of you for marketing purposes without appropriate permission.
D. Feedback . If you provide ideas, suggestions, comments, or other feedback regarding the Services,
Stay may use that feedback without restriction or compensation to you.
12. Acceptable Use and Prohibited Conduct. You agree not to: ● Use the Services for any unlawful, fraudulent, harmful, abusive, harassing, or
unauthorized purpose;
- Submit false, misleading, falsified, altered, fabricated, incomplete, defamatory,
infringing, or unlawful information or records;
- Interfere with or disrupt the Services, servers, networks, app, website, or
operations of Stay;
- Attempt to gain unauthorized access to any account, system, data, or portion of
the Services;
- Copy, modify, reverse engineer, scrape, crawl, or misuse any portion of the
website, app, or Services except as permitted by law;
- Violate or intentionally evade reasonable safety, conduct, or access rules of a
Facility in connection with a reservation;
- Threaten, harass, abuse, or mistreat Stay personnel, Facility personnel,
customers, vendors, or other third parties; or
- Violate any applicable law, regulation, policy, or third-party right. 13. Intellectual Property. The Services, including, but not limited to, the website, mobile application, software,
text, graphics, logos, images, icons, design, trade names, trademarks, service marks, and other content provided by Stay, are owned by Stay or its licensors and are protected by intellectual-property and other laws. Subject to these Terms, Stay grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use in connection with the Stay marketplace. You may not copy, reproduce, modify, distribute, sell, lease, publicly display, publicly perform, or create derivative works from any portion of the Services except as expressly permitted by Stay in writing or by applicable law.
14. Facilities and Other Third-Party Services. Facilities are independent third parties, and Stay does not own or control their premises,
personnel, operations, policies, Pet Care Services, or conduct. Unless expressly stated otherwise by Stay, Stay does not guarantee or warrant a Facility’s licensing, insurance, qualifications, safety, cleanliness, availability, listing accuracy, service quality, suitability, or compliance with law. The Services may also include links, integrations, payment processing, maps, analytics, communications tools, booking tools, app-store services, or other products or services provided by third parties. Stay does not control and is not responsible for third-party websites, applications, platforms, products, services, content, policies, or practices. Your use of a Facility or other third-party service may be governed by separate terms, policies, waivers, or consents.
15. Privacy. Stay’s collection, use, disclosure, and protection of personal information is described in
Stay’s Privacy Policy. By using the Services, you acknowledge that you have reviewed the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
16. No Veterinary or Professional Advice. Stay is a marketplace operator, not a veterinary clinic, veterinarian, medical provider, or
provider of Pet Care Services, and the Services are not a substitute for veterinary care or professional advice. Information provided by Stay through the Services is for general operational, scheduling, marketplace, or customer-service purposes only and should not be relied upon as veterinary, medical, legal, or other professional advice. Information or advice provided by a Facility is the responsibility of that Facility and is not attributable to Stay merely because it is communicated through the Services. You are responsible for consulting a licensed veterinarian or other qualified professional regarding your pet’s health, medical needs, medications, diet, behavior, and suitability for Pet Care Services.
17. DISCLAIMER OF WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES
ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. STAY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, AVAILABILITY, ACCURACY, AND SECURITY. STAY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, AVAILABLE AT ANY PARTICULAR TIME, COMPATIBLE WITH ANY DEVICE OR SYSTEM, OR FREE FROM HARMFUL COMPONENTS. STAY ALSO MAKES NO WARRANTY OR GUARANTEE REGARDING ANY FACILITY OR PET CARE SERVICES, INCLUDING THE CONDITION OR SAFETY OF FACILITY PREMISES, THE CONDUCT OR QUALIFICATIONS OF FACILITY PERSONNEL, THE ACCURACY OF FACILITY LISTINGS, THE AVAILABILITY OR QUALITY OF PET CARE SERVICES, OR ANY PARTICULAR HEALTH, BEHAVIORAL, OR OTHER
OUTCOME FOR A PET.
18. Limitation of Liability. To the fullest extent permitted by applicable law, Stay and its owners, members,
managers, officers, employees, contractors, agents, affiliates, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, loss of data, loss of goodwill, or business interruption, arising out of or relating to the Services, these Terms, a reservation, a Facility, or Pet Care Services, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, Stay will not be liable for the acts or omissions of a Facility or its owners, employees, contractors, agents, or representatives, or for any injury, illness, death, loss, escape, property damage, or other harm arising from or relating to Pet Care Services or conditions at a Facility, except to the extent such liability cannot
lawfully be excluded. To the fullest extent permitted by applicable law, Stay’s total aggregate liability for any claim arising out of or relating to the Services, these Terms, or a reservation will not exceed the service, booking, or platform fees actually retained by Stay in connection with the reservation giving rise to the claim during the three (3) months preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater. Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, Stay’s liability will be limited to the maximum extent permitted by law.
19. Indemnification. To the fullest extent permitted by applicable law, you agree to indemnify, defend
(with counsel selected by Stay), and hold harmless Stay and its owners, members, managers, officers, employees, contractors, agents, affiliates, service providers, and representatives from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your use of the Services; ● Your pet, including any injury, illness, death, bite, property damage,
escape, behavioral incident, or other act or omission involving your pet;
- Information, instructions, records, or User Content you provide; ● Your breach of these Terms or any Stay policy;
- Your violation of applicable law or third-party rights; or ● Any negligent, wrongful, or intentional act or omission by you or anyone
acting on your behalf.
20. Suspension, Termination, and Refusal of Service. Stay may suspend, terminate, restrict, or refuse your access to the Services, your
account, or a reservation if Stay determines that you have violated these Terms, failed to pay amounts due, provided inaccurate or incomplete information, engaged in fraud or misuse of the Services, created a platform or safety concern, mistreated Stay or Facility personnel or others, or otherwise acted in a manner inconsistent with Stay’s policies or marketplace interests. Any such action concerns access to the Services or administration of a booking and does not constitute control over a Facility’s operations or Pet Care Services. Termination or refusal of service does not relieve you of payment obligations or other obligations that accrued before termination. Sections that by their nature should survive termination will survive, including provisions relating to payment, intellectual property, User Content, privacy, disclaimers, limitation
of liability, indemnification, dispute resolution, and governing law.
21. Changes to the Services or Terms. Stay may update these Terms from time to time. When changes are made, Stay may
post the updated Terms on its website or app, update the “Last updated” date, or provide notice by other reasonable means. Your continued use of the Services after updated Terms are posted or otherwise made available constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
22. Governing Law and Venue. These Terms and any dispute arising out of or relating to the Services will be governed
by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent applicable law provides that non-waivable consumer protections of another jurisdiction must apply. Subject to the arbitration provision below and any non-waivable law governing venue, any legal action or proceeding that may be brought in court arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction and venue of those courts.
23. Binding Arbitration and Class-Action Waiver. Any dispute, claim, or controversy arising out of or relating to these Terms or the
Services shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court if the claim qualifies. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Any hearing location will be determined in accordance with the AAA rules and applicable law. You and Stay agree to bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
24. Miscellaneous. A. Entire Agreement . These Terms, together with the Privacy Policy and any additional written policies,
waivers, consents, or service forms provided by Stay in connection with the Services, constitute the entire agreement between you and Stay regarding the Services. Facility-specific rules, waivers, consents, or agreements governing Pet Care Services are separate arrangements between you and the applicable Facility and do not make Stay a party to the Facility’s performance of Pet Care Services.
B. Severability . If any provision of these Terms is found to be invalid, illegal, or unenforceable, the
remaining provisions will remain in full force and effect.
C. No Waiver . Stay’s failure to enforce any provision of these Terms does not waive Stay’s right to
enforce that provision or any other provision later.
D. Assignment . You may not assign or transfer these Terms or any rights or obligations under these
Terms without Stay’s prior written consent. Stay may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, reorganization, financing, or other business transaction. E. Headings . Headings are for convenience only and do not affect the interpretation of these Terms. 25. Contact. If you have questions about these Terms, please contact Stay at: Email: support@staysitplay.com P.O. Box 140490 Dallas, TX 75214-0490 (214) 770-2097
